A Few Legal Definitions Explained

In case it’s not apparent I am a Las Vegas DUI attorney.

As such, it is my job to stay abreast of all the legal definitions that are out there.  Yes, it can get boring, but it is useful information.

Now a lot of these terms are going to be fairly obvious, but I’m going to Define them and talk about them anyways. Give me a break,  I have 400 words I have to write today.

So without further ado, let’s get started:

Breathalyzer

This is any device that is used to determine the amount of blood alcohol level in a person. There are numerous manufacturers of breathalyzers, but they all do the same thing. More than likely, if you have been pulled over, this is the first test they will use on you.

Citation

This is what the cop gives you comma to inform you that you must appear in court. It is a notification that you are being served with a charge for committing a petty crime.

DUI

DUI stands for driving under the influence. This is making the offense of operating a motor vehicle while under the influence, or intoxicated, buy any drug that impairs your ability to drive. this can be drugs of any type but most normally it is alcohol that is the culprit.

DWI

DWI stands for driving while intoxicated. Each state is different, and how they Define these two classifications. I won’t go into detail because it’s deserving of its own blog post down the line.

Hit-And-Run

This is when you are involved in a motor vehicle accident, and you leave the scene of the accident. in many cases this will get you in very deep trouble. The only reason you might get what off the hook, is if you went to the hospital after to address a serious injury that was life or death dependent.

Horizontal Gaze Nystagmus Test

This is a test that cops may use to test your vision. It helps them to look at your eye movement which gives off signs of being intoxicated.

Motor Vehicle Record

This is the full history of any accidents or traffic violations you may have had.   typically the insurance agent will use this to determine how much you have to pay for coverage, or even to determine  if they will cover you.

Moving Violation

This is any law broken while the vehicle is moving. It can also be applied to Drunk Driving.
